Exclusivity

What this is about

The term appears in several shapes and they get mixed up easily. A performer can be barred from competing brands for a period; a piece of music can be licensed so nobody else may use it; a supplier can agree to serve one client per category. Each variant removes earning opportunities from the other side, which is why exclusivity is priced on top of the usage grant instead of being assumed inside it. Define competing category, territory and duration precisely — an open-ended exclusivity is hard to price and harder to defend later.

A term only helps when everyone on set means the same thing by it — so what follows is how it is used, not a dictionary definition.

What runs differently here

In planning terms, that means:

• Exclusivity and usage rights are separate deals — a broad usage grant is not automatically exclusive
• Name the competing category, territory and duration; open-ended exclusivity cannot be priced fairly
• The other side loses bookings, so exclusivity is charged on top rather than quietly included
